Contested Divorce
Representation where the parties cannot agree on the terms of their divorce — from case conferences through to trial if necessary.
When spouses cannot agree.
Not every divorce can be uncontested. Where there are unresolved issues — parenting, support, or property — the file must proceed through the Ontario family courts.
The process
- Application and Answer — setting out each party’s position.
- Financial disclosure — Form 13 or 13.1 financial statements, sworn and exchanged.
- Case conferences — judge-led settlement discussions that often resolve files without trial.
- Motions — temporary orders for support or parenting while the case is pending.
- Settlement conferences and, if needed, trial.
Most contested files settle at a case or settlement conference. The firm’s approach is to prepare every file as if it will go to trial, so that settlements happen on fair terms rather than under pressure.
