An uncontested divorce is available to married spouses who have lived separate and apart for at least one year and who agree on the terms of their separation — or who have no outstanding issues to resolve (no dependent children requiring support orders, no unresolved property or support claims).
What is included
- Review of your separation arrangements and advice on whether an uncontested application is appropriate.
- Preparation of the Form 8A Application (Divorce).
- Filing with the Ontario Superior Court of Justice (Family Court branch where applicable).
- Service on the responding spouse (where a joint application is not being used) and proof of service.
- Affidavit for Divorce and supporting documents.
- Follow-through to the Divorce Order and Certificate of Divorce.
Fixed fees wherever possible
Most uncontested divorces can be quoted at a fixed fee. The firm will discuss fee structure at the intake conversation, so there are no surprises.
Joint or simple uncontested?
Spouses who agree fully can file a joint application — no service, no respondent, no default period. Where one spouse has already left the relationship and does not intend to oppose, a simple uncontested application is filed and served. The right choice depends on the circumstances, and we’ll confirm which at intake.
What can go wrong
Most problems with uncontested divorces are self-inflicted: incorrect address on the application, the statutory one-year separation not properly established, defective service, or omitting the required Registration of Divorce form. Proper handling avoids all of it.
